I am associated with Ministry of Corporate Affairs, Indian Institute of Corporate Affairs and Indian Institute of Arbitration & Mediation. My mediation training includes: 1) Trained by IIAM, Year of Training: 2016; 2) Trained by IICA under the aegis of Ministry of Corporate Affairs, Year of Training: 2016. I am an empanelled mediator under the Ministry of Corporate Affairs, in the capacity of an expert in mediation or conciliation who has successfully undergone training in mediation or conciliation as per Rule 4(i) of Companies (Mediation and Conciliation) Rules, 2016. My mediation experience has also been in my capacity as an advocate representing parties in mediation. The said role has enabled me to: 1) Advise clients as to whether mediation is suitable in a given case. 2) Enable clients to prepare a negotiation strategy by helping the client to undertake SWOT analysis, examine the zone of possible agreement (ZOPA), formulate worst alternative to a negotiated settlement (WATNA) and best alternative to a negotiated settlement (BATNA). 3) Prepare clients for mediation. 4) Appear in mediation proceedings along-with clients and advising them. 5) Participate in mediation proceedings, either by spearheading it on behalf of the client or by augmenting the client's role or by advising them in relation to mediation proceedings. 6) Drafting the settlement terms and working in the direction of making them enforceable. I prefer combining different mediation styles.
